Terms of Service

These Terms form a binding agreement between you and PocketShell, a service operated by A.G. Software Technologies, based in Lucknow, India. By signing in or otherwise using the PocketShell mobile applications, host agent, or related services, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 16 years old. App-store content ratings are separate distribution labels and do not change this contractual minimum. Accounts are for individual users; shared team accounts, organisation accounts, and bot accounts are not currently supported.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the PocketShell mobile app on devices you own or control. The host agent is open source under the Apache License 2.0 and governed separately by its license at github.com/yashagldit/PocketShell.

3. Acceptable use

Only connect to hosts you own or are authorized to operate. No illegal use, no abuse, no rebroadcast, no resale, no circumvention of subscription limits, and no reverse engineering except to the extent applicable law permits despite that restriction.

4. Subscriptions

PocketShell Pro is offered as monthly, annual, and lifetime plans through the Apple App Store and Google Play. Subscriptions automatically renew unless canceled at least 24 hours before the period ends. Manage subscriptions in Apple ID Settings or Google Play Settings. Refunds are handled by Apple / Google under their policies.

5. Apple-required terms

PocketShell is solely responsible for the licensed application and its content. Apple is not responsible. Apple has no warranty obligation. Maintenance and support are PocketShell's responsibility. The end user must comply with applicable third-party terms of use. Apple is a third-party beneficiary of these Terms and may enforce them.

6. Disclaimer & liability

The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, PocketShell's total aggregate liability is capped at the amount you paid for PocketShell in the twelve (12) months preceding the event giving rise to the claim. No indirect, incidental, special, consequential, or punitive damages. Nothing here excludes liability that cannot be excluded under your mandatory consumer law.

7. Termination

You may terminate at any time via Settings → Account → Delete Account. We may suspend or terminate for breach of the Acceptable Use section. Subscription cancellation must be done separately via Apple ID / Google Play.

8. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, except that mandatory consumer protections of your country of residence continue to apply. Disputes will be brought exclusively before the competent courts at Lucknow, Uttar Pradesh, India, except where mandatory consumer rules in your country of residence give you the right to bring proceedings before your local courts. To the extent permitted by law, you and PocketShell agree to resolve disputes on an individual basis only and waive any right to participate in a class or representative action.
